NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

FOR TIERED PROJECTS AND PROGRAMS

On or after 04/19/2022 the County of McKean will submit a request to the Pennsylvania Department of Community and Economic Development (DCED) for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake the following project:

Tier 1 Broad Review Project/Program Title: Bradford Township Housing Rehabilitation

Purpose: This funding will assist low to moderate income homeowners with critical housing repairs to increase their safety and physical well-being and to bring the homes up to code.  Housing repairs may include, but not limited to, the following: roofing, windows, doors, siding, electrical wiring, plumbing, removal of mold, installing smoke alarms, lead abatement, testing and treatment for radon, repair or replacement of foundations, porches and steps.  Work will be completed by qualified registered home contractors. Rehabilitation of up to 2 homes is anticipated.

Location: Within the municipality of Bradford Township.  

Project/Program Description: Assist low to moderate income eligible homeowners with repairs that will bring their homes up to code. A scope of work will be completed and then projects will be placed out for bid and awarded based on the lowest qualified bid received. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Level of Environmental Review Citation: 24 CFR Part 58.35 (a)(3)(i)

Tier 2 Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: When specific property sites are identified, we will review for Contamination and Toxic Substances at 24 CFR Part 50.3(i) and 58.5 (i)(2) ; Explosive and Flammable Hazards at 24 CFR part 51 Subpart C; Floodplain Management – Executive Order 11988, particularly section 2(a); 24 CFR Part 55;   Historic Preservation sections 106 & 110; 36 CFR Part 800; and Noise Abatement and Control at 24 CFR Part 51 Subpart B.

Mitigation Measures/Conditions/Permits (if any): Contamination and Toxic Substances will be reviewed for proximity to any EPA/CERCLA sites during Tier 2 Review; Explosive and Flammable Hazards will be reviewed to ensure there are no hazards on the project site or nearby; Floodplain Management will ensure that the rehab will not be located in a Flood zone; Historic Preservation – will consult with PHMC/SHPO on individual sites; and Noise Abatement and Control measures will utilized during rehabilitation when replacing windows, doors or siding.

Estimated Project Cost: $82,616.00.

The activity/activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.35 (a)(3)(i). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at McKean County Redevelopment and Housing Authority, 415 West Main Street, Smethport, PA 16749 and may be examined or copied weekdays 8:00 A.M to 4:00 P.M.

PUBLIC COMMENTS 

Any individual, group, or agency may submit written comments on the ERR to Lori Freer at the McKean County Redevelopment and Housing Authority. All comments received by 4/18/2022 will be considered by the McKean County Redevelopment and Housing Authority prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

The County of McKean certifies to DCED that Thomas Kreiner, Certifying Officer, in his capacity as McKean County Commissioner Chair, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DCED’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of McKean to use HUD program funds.

OBJECTIONS TO RELEASE OF FUNDS

DCED will accept objections to its release of fund and the County of McKean’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of McKean; (b) the County of McKean has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by DCED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to PA Department of Community and Economic Development at: chrhowe@pa.gov . Potential objectors should contact DCED to verify the actual last day of the objection period.
